I thought I should share with our readers about what is going about our Constitution draft campaigns. The on-line community is not asleep! They are working around the clock to discuss and explain all about the draft Constitution. The YES campaigns are on and they are gathering  enormous energy everyday..       Any other written law is of course penal code and section 240 of it
      allows it in case of emergency treatment or when life of mother is in
      danger which does not ccontradict provisions of the all article 26.

      I am sorry! The any other written law does not say where it is and is
      open to interpretation. However, since you seem to have read the
      document, I wonder if you can help to define any section (s) that can
      lead to such a case… or is this left to the parliament? Please
      enlighten… but what you quote is probably meant to be a joke… right?

      No
      Mr.Kuria here is full section 240 of kenya penal code: “240. A person
      is not criminally responsible for performing in good faith and with
      reasonable care and skill a surgical operation upon any person for his
      benefit, or upon an unborn child
      for the preservation of the mother’s life, if the performance of the
      operation is reasonable, having regard to the patient’s state at the
      time and to all the circumstances of the case.”

      article 26 did
      not leave it to parliament so there is no place for parliament here, if
      you want section in document to define that, you just need to know which
      law punishes penal crimes, and where could other written law comes from
      if section 26 did not metion parliament.

      Kenya penal code has
      been there since 2 August 1930, even Lancatser constitution did not
      touch i,t it just made sure that it conform with provisions of all its
      articles even this constistution will just do the same.See More

      26(4) Abortion is not permitted,…….. from this section we clearly
      see that abortion is not legalised and interpretaion of section 240 of
      penal code goes very well with conditions of second part of this article
      26(4)….unless. so
      what this means is that even though it is not allowed there are
      exceptional conditions(human, health) which are within legal provisions
      in this constitution that can make it permitted.

      It is the case in Italy which allow abortion for the first 90 days of pregnancy, case in Mexico or any other catholic nations.See More

      ‎@Jane nobody is misusing ‘health proffesional’, but in this article
      refers those marginalized areas where Dr. are not available but only a
      nurse or a Clinical officer are found. What wil happen to the life of a
      woman or child in danger who can’t access good facilities and are far to
      reach? Then they are left to die or to suffer? The nurse n clinical
      officer in this case are health proffessional and they can save life.
      The draft constitution therefore, is good and give room of inclusiveness
      to all kenyans.

      “No” Citizens… Imagine a situation my/your sister’s/mother’s life is
      endangered during her pregnancy… she is advised by a professional
      clinical medic that abortion is a must if she has to live.. On a moral
      stand point, Citizen, would you allow the girl to die with the fetus in her womb, or you would planned abortion to safe one life?
      On
      the same moral platform, you have a danger approaching that might kill
      both the mother and the fetus (say, two people). Government
      Constitutionally provision number 1 is to protect Citizens. You are the
      chief advisor to the government and you are deployed to duty on this
      abortion case.. What will be your advise? Let the pregnant sister or
      mother and her baby (human being whether 1 day or 18 weeks or older) in
      the womb to perish in the name of protecting life or safe the mother and
      risk the fetus life?
      Does it make sense to safe a fetus which might not survive anyway and let the life of a full bodied human being lost so cheaply?
      Here and now, it seem we are not yet there, on a platform where you discuss abortion on women’s rights point of view..
      Honestly,
      any rightful thinking woman in Kenya today, after 47 years of
      systematic discrimination is expected to vote YES and reclaim their
      rights.

      is not meant to be a doctrine one particular group, “life begins at
      conception”: This belief is held by most Christians (not all) but not
      shared by Muslims, Hindus, Traditionalists, Atheists and others. This
      means it is in direct contravention with the article on Freedom of Religion, which states that, no one religion can impose on another.

      that the country has less than 100 qualified gynaecologists, who would
      meet the church’s requirements that “trained health professional” must
      be only gynaecologist.. Do you have to leave all the way from Oldonyiro
      to Nairobi to meet one in case of emergency or in case life of a mother
      is in danger?

      Balance it this way if you like, the current paper does
      not protect the majority because of the poor Bill of Rights. That is why
      many of us are suffering.. Do you wnat to keep it?
      The draft is somewhere around 98% correct. The 2% which is not correct will be amended later.
      Michael,
      St: Peter was an apostle in the 1st century. What was true then, in in
      that world is not in the year 2010. Things have changed.
      Remember the words of (God) to you/Adam and Eve, Go and conquer the world. He gave you the brains.
      Then Jesus came to update laws of Moses and renew our love agreement with God.
      He left us with the Holy Spirit(Knowledge) to lead us. Pee eitapaash yiook ildidingeta lekuarie o ledama.
      The
      Draft is all inclusive.. When you come to understand what a
      multi-ethnic/religious country means, you will appreciate the fact that
      law must equally protect all regardless of their colour, religion or
      ethnic belonging or class or gender and sexual orientation… but maybe
      most of us are not yet there?
      In all cases, we strive to restore
      human dignity, equality, equal respect through among others,
      Constitutionally based National laws.
      VOTE YES and gives Kenya a chance to be independent.

      the government to ensure that our hospitals are well staffed & we
      need not to give excuses by allowing unqualified personnel to make
      decisions.

      on the two clauses on when “life begins & freedom of religion” as
      you’ve put it, is a clear indication of how faulty the doc. is.

      a constitution is just but a legal framework & can not solve all
      our problems & can not make us all happy but we have to point out
      issues that do not make us happy now.

      win we start ammendments, if we win we start negotiations & finally
      we shall have one Kenya; one People; one country.

      and me agree without living in autopic quagmare that our governement
      have no such capacity to stuff all Hosipitals; In the far North where i
      was born nearest Wamba Hospital
      is 186 Km from my village; no road, no cars and no even any element of
      modern civility you will like talk about….Here we use local herb
      called “lgiriai” or “lmakutikuti” to treat things like miscariage or
      help women in complicated pregnacies to carry out abortion…..most
      cruel even we have what is called “nkuronyo” meaning stomach pressing
      till abortion occur…. Don’t tell me this is not part of Kenya. When
      church pedle falsehoods and lies on abortion nobody is ready to buy it,
      some us who are widely travelled know what it means when we talk about
      abortion. If you are catholic ask you Italian priest friend or a Nun
      what they say in Italy; a modern country with all those things you would
      like us to have in our country why do they allow abortion first 90 days
      of pregnancy?.

      ever there will be another chance to get a good constitution that give
      women and marginalized communities voices is this draft constitution. We
      keep on always making noises and shouting we are marginalized and yet,
      we cannot even make the right decisions when the opportunity presented itself.

      The
      main reasons, why I, Jane Naini Meriwas is vote YES in this draft
      constitution, it give voices to the local people, women and less
      represented PERIOD; in terms of counties, women/youth representation,
      minority groups etc. But if you got all the above then you vote NO
      because you got nothing to lose. Vote peaceful in August 4th and make

      The
      mother on a top of the tree singing to her only child that she may
      sleep so that when the enemy comes in the wee hours they may find her a
      sleep and thus may not see or hear her and in that way, she maybe
      saved.
      I have been thinking about this story and if you analyse it
      deeply with honesty, the Maasai were not just talking about their enemy
      at that time, they were telling the story of a citizen, who is left
      without any whatsoever protection, who has to rely on her own expertise
      to protect her life and that of her daughter( I don’t know why I think
      it was girl) The female instinct is so powerful that she had to do what
      she must do at the time so that she can do what she wants to do when
      freedom and equality, justice and equal respect, solidarity and peace
      runs down the mighty streams of this Godly Nation. The sixth sense owned
      by women is what makes this nation stand out. For where would we be, if
      it were not for the African woman?
      The baby was innocent but she
      must have grown up to learn that if she has to be protected, she’ll have
      to gather knowledge her self and apply it appropriately to defend not
      only her life, but that of her mother and sisters and brothers.
      Sometimes
      you may attain a wealth of knowledge but you fail to lead your people
      with it, to rely on it or to share it with someone else. Others acquire
      the powerful weapon and use it against their own people. They apply
      knowledge to rob the single unprotected mother on the top of the trees
      who’s little knowledge tells her security can be on higher grounds but
      if she can only sing her baby to sleep… she might survive.. her world
      is a world where human life is gain on a Royal sanctuary, lived cheaply
      and maintained by charity at the mercy or mere ignorance of enemy.
      The
      enemy knows your weakness, your own ignorance to what matters to ya! He
      comes in the night while you sleep and listen and wait out for the
      right time..
      That night while the enemy passed, Nkaipoponi ai
      survives and she lives one more day. She was entitled the benefit of
      Charity but her nights are not safe and she may have expired her enemy
      controlled right to life! The enemy here is (poverty, ignorance,disease,
      marginalization etc) control)
      I can’t stop thinking about Nkaipoponi ai!Her mother brings her up and takes all the humiliations just to see her live.
      Now
      Nkaipoponi ai is strong and a live , she’s well informed and yet she
      refuse to use her fantasy on what is good for her. She refuse to reclaim
      her God given rights tolife, liberty and the pursuit of good life!
      Nkaipoponi
      ai projects some kind of scaring ignorance which sincerely does not
      resemble… While her mother taught her to seek justice at all cost,
      Nkaipoponi ai ignores the call and vote against her GOD given rights.
      She’s
      given freedom but she chooses tree tops, she’s given voice but she
      retains the pipping Nkaipoponi’s mother’s voice on tree tops..
      She’s
      given recognition, Constitutional frame work and guidelines for justice
      but she chooses to stay down in the valley of death..

      Sometimes
      you want to tell people something but you realise they won’t get it any
      way.. Who knows, who knows, it might be beneficial for them to vote NO.
      My
      dear NO sister and brother, as much as you want to retain STATUS QUO,
      and keep suppressing Nkaipoponi mother’s dreams on restoration of human
      dignity due to your selfishness, like Rev. Gitari and President Kibaki
      said yesterday August 27th 2010, you are doing a DE-SERVICE to this
      great Nation KENYA ( the land of the future).
      I personally ask you to
      evoke the spirits of Ngoto Nkaipoponi from her grave (if she had one
      because I doubt owing to the human degradation systematically
      perpetuated by the Colonial Constitution from which we have been
      governed under since 1901 and again the current one since 1963) to help
      you to sanity so that you see the agency of ,VOTING YES and make this
      land of the future(Kenya=future in Kimaasai)

      am in heavy dialogue with Mwangi Kiunjuri.:) we need more support and
      the LW MP as well… they must support us to acquire our own majority in
      the name of justice and solidarity with the marginalized groups. The
      wananchi of the Laipia West
      and East are actually accepting the fact that for us to grow us a
      country, we need to let the pastoralist manage their local affairs. You
      know why? because the pastoralists employs 40% workers in this country.

      Cattle
      keepers contributes up-to 60% of the BNP. If we(country) continue
      mismanaging this powerful resource, we may not lead a sustainable
      economical development. Their roads should actually been modernized long
      time ago… but who was your representer?

      Hiyo council ya Nanyuki pia ni yetu.. and they are collecting a lot of revenue everythime I sell a goat or cow etc.
      And above all, we are still working on LNC demand and we have not yet given up.
      The
      new law will give us even more powers, Bill of Rights shall make us
      powered to demand our own rights to locally govern ourselves..

      That is what devolution does, it decentralizes administration, powers
      and it is obvious LNC must be considered by the Interim Independent
      Boundaries Review Commission (IIBRC).

      am sure with respect to our distinct rich cultural & economic
      activities which can go far in developing our land & neighbours, the
      committe will bow to our demands for Laikipia North Constituency..

      But there is
      a big issues on the boundaries where the haves in Laikipia North
      intended to have the ranches excluded from the constituency to continue
      benefiting in expense of the communitynat large.

      We can go far;

      As we discussed in our other forum, our cultures are so rich that we
      can sell it to the entire world and all the income shall be invested in
      building our welfare. August 4th is not final but only an opening to the
      gates of freedom. However, we will refuse to run out of slavery to
      Canaan just because you fear the desert and the warring entities along
      the way.
      In Mukogodo, I just confirm on telephone that only an area
      chief and a former higher ranking National leader who are on the NO
      side. My Mother Sokoyian(Enkayioni Ole Mayiani;) and my daddy (Nkera
      Oosieuri) and all my mother and fathers in Mukogodo and Endana are all
      on the Right side of History.
      Talking on phone, agents of change on
      the ground in Endana said that there are about two Ruto’s(No) in the
      area. Asked why one of the RUTOS voting no, I don’t know – the RUTO
      answered. Because the former higher ranking Mukogodo Maasai leader is
      voting NO.
      I happy to announce that we have reached a consensus with
      the two RUTO’s in Endana and now they are perfectly on the RIGHT side of
      HISTORY.
      Brother M. Kibiru, thank you for such a nice conversation
      we had. I was touched and and I also feel for you because you are in the
      same situation as I am. We share the sorrows of this loving nation but
      on the 4th of August, some things will just have to be very different!!!
